Welcome to Kwik Nkap, a digital platform provided by Enchird Technology Ltd, registered under the laws of Cameroon. These Terms and Conditions ("T&Cs") govern your access to and use of the Kwik Nkap mobile application, website, and all associated products and services.
By creating an account, accessing, or using any part of the platform, you agree to comply with and be bound by these T&Cs. If you do not agree with any part of these terms, please do not use our services.
1. Introduction
These T&Cs form a legally binding agreement between you and Kwik Nkap. They govern your use of our mobile application, website, and related digital financial services. Please read them carefully before accessing our services.
2. User Eligibility
To use Kwik Nkap:
- You must be at least 18 years old.
- You must have the legal capacity to enter into a binding agreement.
- You must provide accurate, current, and complete personal information during registration and maintain its accuracy thereafter.
We reserve the right to decline or revoke access to users who do not meet these criteria.
3. Account Responsibility
- You are solely responsible for maintaining the confidentiality of your login credentials.
- Any activity conducted through your account is deemed authorized by you.
- You must immediately notify us of any unauthorized access or suspicious activity related to your account.
Kwik Nkap will not be liable for any losses arising from unauthorized access resulting from your failure to secure your credentials.
4. Services Provided
Kwik Nkap provides access to various digital financial tools and services, including:
- Digital Wallet & Payment Processing — for storing funds, transferring money, and making purchases.
- Event Booking & Ticketing — enabling users to find, book, and pay for events seamlessly.
- Micro-Savings — small, flexible savings plans to help users build financial discipline.
- Micro-Lending (coming soon) — short-term, small-value loans offered through our licensed banking partners, subject to eligibility and approval.
- Expense Tracking & Personal Finance Tools — budgeting, reporting, and analytics to help users manage finances.
Some of these services are offered in partnership with licensed third-party financial institutions.
5. Fees & Transactions
- Certain services may incur transaction fees, which will be transparently disclosed before confirmation.
- By initiating a transaction, you authorize Kwik Nkap to debit or credit your wallet accordingly.
- You are responsible for ensuring your wallet has sufficient funds to complete transactions.
We reserve the right to update our fee structure from time to time. Users will be notified of material changes.
6. Data Protection & Privacy
Your personal data is handled in accordance with applicable data protection laws and our Privacy Policy, which explains how your information is collected, used, stored, and shared. By using our services, you consent to the collection and use of your data as outlined in the policy.
7. Suspension or Termination
Kwik Nkap may, without prior notice, suspend or permanently disable your access to the platform if:
- You violate any provision of these T&Cs;
- Fraudulent, illegal, or suspicious activity is suspected;
- You provide false information or misuse the platform.
We may also terminate accounts inactive for extended periods.
8. Limitation of Liability
Kwik Nkap, its officers, agents, or affiliates will not be liable for:
- Any indirect, incidental, or consequential losses;
- System outages, delays, or disruptions;
- Losses resulting from third-party services or network failures;
- User negligence or failure to adhere to security measures.
Liability is limited to the extent permitted under the laws of Cameroon, except in cases of gross negligence or willful misconduct on our part.
9. Changes to Terms
We may update these T&Cs periodically to reflect changes in our services, regulatory obligations, or business practices. Continued use of the platform following any such changes will constitute your acceptance of the revised terms. You are encouraged to review the T&Cs regularly.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cameroon. Any disputes arising under or in connection with these T&Cs shall be submitted to the competent courts of Cameroon.
